These Terms of Service (“Terms”) are entered into by Ascension Chess LLC (“Company,” “we,” “us,” “our”), operating as Ascension Chess Academy. These Terms govern your access to and use of our services, including our website (chessascension.com), scheduling platform, and all lessons provided by our instructors. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully. If you do not agree to these Terms, you must discontinue use immediately.
Supplemental terms or additional agreements may apply to specific features or services and are hereby incorporated by reference. We reserve the right to update or modify these Terms at any time and for any reason. Changes will be effective upon posting, and continued use of our services constitutes acceptance of the updated Terms.
1. Services Provided
1.1 Lesson Packages:
We offer private (1-on-1) and semi-private (up to 3 students) lessons. You may purchase a single lesson or subscribe to monthly plans that include 4 or 8 lessons per month. Full details and pricing are available on our website.
1.2 Scheduling:
Lessons are scheduled through our online scheduling platform (currently powered by Acuity Scheduling). Upon subscribing, you’ll receive a code to redeem your lessons. Single lessons are scheduled immediately at checkout.
1.3 Lesson Expiration
Unused lessons roll over for up to 90 days after the billing date. Lessons not used within this timeframe are forfeited.
1.4 Instructor Assignment:
Lessons are conducted by our experienced instructors. While we aim to match you with the same instructor for continuity, this is subject to availability.
2. Payments and Refunds
2.1 Payments:
All payments are processed securely through third-party providers, including Stripe and PayPal. We do not store your payment details.
2.2 Refund Policy:
Refunds are available for unused lessons within 14 days of purchase. Refunds will not be issued for lessons already conducted. For more information, please review our Refund Policy.
2.3 Subscription Renewals
Subscriptions auto-renew monthly unless canceled. You can manage your subscription at any time via the link provided in your confirmation email.
2.4 Promotional Offers:
Promotional pricing and discounts may be subject to additional terms, which will be clearly stated at the time of the offer.
3. Rescheduling and Cancellations
3.1 Rescheduling and Canceling Lessons:
Lessons can be rescheduled or canceled using the scheduling platform (currently powered by Acuity Scheduling) through the link provided in your confirmation email or by contacting us via email at [email protected].
3.2 Advance Notice Requirements:
Both rescheduling and cancellation requests must be made at least 24 hours in advance. Requests made with less than 24 hours’ notice may not be accommodated. Canceled lessons with appropriate notice allow you to reschedule or receive a credit for a future lesson, while lessons canceled with insufficient notice are considered forfeited and are not eligible for refunds or rescheduling.
4. User Responsibilities
4.1 Account Information:
Users must provide accurate and complete information when booking lessons. Contact information should be updated promptly if changes occur.
4.2 Code of Conduct:
Users are expected to engage respectfully with instructors and other participants. Disruptive or inappropriate behavior may result in termination of services without refund.
4.3 Technical Requirements:
Users are responsible for ensuring a stable internet connection and access to the required platforms (e.g., Zoom) for lessons.
4.4 Recording Restrictions:
Recording lessons is prohibited without explicit written consent from Ascension Chess Academy and the instructor.
5. Intellectual Property
5.1 Content Ownership:
All materials provided during lessons, including curricula and study resources, remain the intellectual property of Ascension Chess Academy. Reproduction or distribution of these materials without permission is prohibited.
5.2 Website Content:
Content on our website, including text, graphics, and logos, is protected by copyright laws and may not be reused without our written consent.
6. Limitation of Liability and Disclaimers
6.1 Service Interruptions:
While we strive for uninterrupted service, we are not liable for delays or disruptions caused by technical issues or circumstances beyond our control.
6.2 Disclaimer:
THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL MEET YOUR EXPECTATIONS OR BE ERROR-FREE.
6.3 Liability Cap:
To the maximum extent permitted by law, our liability is limited to the amount you paid for the service in question.

8. Dispute Resolution and Governing Law
8.1 Governing Law:
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws principles.
8.2 Dispute Resolution Process:
- Informal Negotiations:
Before pursuing formal resolution, both parties agree to first attempt to resolve disputes informally by contacting us at [email protected]. Both parties will engage in good faith efforts to resolve the issue within 30 days. - Binding Arbitration as Last Resort:
If informal negotiations fail, disputes shall be resolved exclusively through binding arbitration as a last resort. Arbitration will be conducted in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The process will be conducted remotely whenever possible to minimize costs. Arbitration decisions are final and enforceable by courts.
8.3 Court Involvement:
Court involvement is limited to enforcing an arbitration award or addressing excluded claims (e.g., intellectual property disputes). Such matters will be resolved in Maryland courts, and both parties consent to their jurisdiction.
